ASSAULT CHARGE FAILS

In the Lismore Quarter Sessions Court, before Judge Mocatta, Thomas James Howe,  [51], a stranger, was charged with, on December 20, 1923, assaulting a male person, [Robert Walter Nathan Claydon ], at Ballina.

Accused was undefended and appealed for legal assistance, which was not granted, accused having had already several months to prepare for his defence.

His Honour said that he and Mr Browning (Crown Prosecutor) would watch the case in his interests and see that nothing unfair took place, or that his case would in any way be prejudiced.

Accused was found not guilty and discharged.
