George Livingstone was brought up charged with the larceny of some old lead, the property of F Withers.

Constable [Frank] Thornley deposed to arresting accused. When I saw him on Monday evening, said to him, “Did you sell any lead to Newell?” He replied “Yes.” I said, “What sort of lead was it?” He said, “An old square thing.” Asked him where he got it. He said, “Out of Withers’ back yard.” I said, “Did any one give you permission to take it?” He said, “No, I thought it was no good, so I took it. I found it near the rubbish heap.”

Albert Newell, tinsmith, deposed: I know accused. Purchased the leaden trough (produced) from accused at my shop. Gave him 4s for it about 6 weeks ago.

Frederick Withers, confectioner, deposed: The leaden trough produced is my property. Value it at about 6s as old lead. It was kept in my back yard. Did not sell it to accused or authorise him to take or dispose of it.

Accused, who pleaded guilty, elected summary jurisdiction and said he did not wish to give evidence or to say anything.

ALLEGED INDECENT ASSAULT.

George Livingstone was brought up on a charge of indecent assault.

Sen. Con. Richards deposed that in company with Con. Smith, on Sunday morning last, he saw accused in a house in Coleman’s Lane. Accused was lying down and witness acquainted him with their business. They conveyed accused to the lockup and charged him with having committed an indecent assault on a boy named George Clancy. Accused replied “Can you swear it?” Witness said to accused “that is the charge against you.” Accused said, “I can bring witnesses to prove that I did not.”

George Clancy deposed that he was 10 years of age, and accompanied accused under Fawcett Bridge on Saturday night. He described the nature of the alleged assault.

John Johnsen Mallon gave evidence of having witness the occurrence.

The accused was then formally charged by the PM, but replied that he had nothing to say. The Bench committed the prisoner for trial at the Lismore Quarter Sessions on Friday, March 10. The witnesses John Clancy (father of the boy), Sen. Con. Richards, and JJ Mallon were then bound over to appear.

POOR PRISONERS’ DEFENCE ACT.

There were three applications made by accused persons on Friday at the Quarter Sessions to Judge Edmunds for legal assistance as provided by the Poor Prisoners’ Defence Act . The first applicant was Oliver Miles, who said he first became aware of the Act by reading a notice in the exercise yard of the Grafton Gaol. Miles’ appeal was successful. An hour later another application was received from Thomas Turner McDonald, who appeared to be on the verge of mental collapse. He, too, was successful in obtaining the necessary recommendation. Just before lunch a third application was handed in from George Livingstone, who was heard in support of his request during the afternoon. In answer to his Honor, he said he had only heard of the Act on the previous day. He did not state how he became aware of its existence, but the Crown Prosecutor volunteered the information that Miles was no doubt at the bottom of it. His Honor granted the application. There can be no doubt as to the justice of the Act, but if it is not to be abused earlier notice than given yesterday should be insisted upon in making application in accordance with its provisions.
