ORANGE POLICE COURT.
———

At the Orange Police Court this morning, before Mr E Marriott, PM.
…

ALLEGED ASSAULT AND
ROBBERY.

William Wilson and Joseph Perry [aka Patrick (or Joseph) Kennedy] were charged with stealing in company 1/-. Inspector Banks withdrew the charge in view of another case against the accused. The accused were then charged with assaulting and robbing Alfred O’Connor of the sum of 7/6 on the 9th of November.

Senior-Constable Byrne deposed to going in search of the accused, at a quarter to 1 o’clock this morning; I saw the two accused coming with their swags on to the railway platform; I called O’Connor, who identified the men; the accused denied seeing O’Connor before; O’Connor gave the men in charge for assault and robbery; I arrested the accused, and brought them to the lock-up; on searching Wilson I found the sum of 3/7, which he said was the balance of some money he earned on the permanent way at Bathurst; this morning I went to the cricketer’s reserve in Lord’s Place; I saw O’Connor pick up the bottle produced; I believe it contained rum.

Alfred O’Connor deposed: I am a labourer employed by Mr McLachlan solicitor, of Orange; I recognise the two accused; I was returning home last night about a quarter past eleven; I went into the reserve; on going through the turnstile I saw a man named Hughes; I entered into a conversation with Hughes; Two men jumped over the fence and sat down on the ground near Hughes and I; Wilson said “What about some drink I have fourpence,” I said, “You can’t get any more drink to-night;” Wilson said, “Give me the money, and I will get the drink;” gave him 1/8; Wilson did not move away to get the liquor, so I asked for my money back; We al got up; the accused said they would get the liquor; Perry had hold of me; and took a bottle containing rum out of my pocket; the liquor was drank between us; I then made to get away, when Perry stopped me, he got hold of me and put his arm under my chin, and put my back against the fence; with one hand he went through my pockets; Wilson also went through my pockets. I had 7/6, and some tobacco and cigarettes; Perry took the money out of my pocket; Hughes was standing by and said ‘Leave the man alone’; I went to leave, when Perry told me not to; went in search of a constable; with the constable I found the accused coming on the railway platform; when they were arrested.

By accused Wilson: Hughes was ten feet away when Perry had hold of me.

By the police: The back pocket of my trousers was searched by Wilson; I had a pocket knife there; I requested Wilson not to take my knife, and he left it in my pocket.

By the PM: Perry used violence in placing his hand under my neck.

William Hughes, a laborer, deposed: I was camped on the Cricket reserve near the Rugby Hotel last night; I saw Alfred O’Connor last night; he came to where I was camped, and joined in conversation with me; I saw Wilson and Perry jump over the fence; Wilson said “we are not going to hurt you, we are tramps like yourselves;” a conversation ensued about dring; [sic] as accused did not go for it O’Connor asked for the return of his money; Perry put O’Connor back against the fence, while the other accused went through his pockets; I told them to let the man alone; Wilson said “you have a lot to say, perhaps you have money;” Wilson put his hand under my chin; I saw O’Connor leave; the accused then left the scene.

By accused Wilson: I cannot say how Perry had hold of O’Connor; I have met you before, and had drinks with you.

By accused Perry: You did not put your hand in my pocket; it was Wilson who robbed O’Connor; you took a bottle of rum out of my pocket, which was shared by the company.

The accused reserved their defence, and were committed for trial at the quarter sessions to be held at Orange on November 28th, or such time or place as the Attorney General may appoint.

ANOTHER CHARGE.

The accused were then charged with in company, assaulting and robbing William Hughes of 1/-.

Senior Constable Byrne deposed to arresting the accused; on the way to the lockup a man named Hughes said to Wilson “you are fitted at last nugget, you ought to get ten years;” Wilson made no reply; Hughes had drink, but was sober.

William Hughes gave similar evidence to that he gave in the previous case; Wilson assaulted me; I told him I only had a shilling; Wilson further said if I did not keep quiet he would hit me on the point; Perry was standing close by; the two accused then left.

Alfred O’Connor also gave evidence, and the accused were committed to take their trial.

ORANGE QUARTER SESSIONS.
———

The Quarter Sessions were opened in Orange yesterday, before his Honor, Judge Docker, Mr J Carlos being Crown Prosecutor.

The legal profession was represented by Messrs McLachlan, HH Lee, and LA Lane.
…

ALLEGED ASSAULT AND ROBBERY.

William Wilson and Joseph Perry were charged with having, in company, robbed O’Connor of 7/6.

    The accused pleaded not guilty.

The following jury was empanelled: JS Withington, John Thomas, WV Olver, James Tracey, WJ Gifford, WC Bernasconi, MJ Fitzgerald, AH Griffith, Thomas Dudley, senr, JL Buesnel, PS Garling, John Maher.

The evidence for the prosecution was similar to that published in “The Leader” of 10th November.

Both accused made statements from the dock, denying the charge. Wilson suggested that it was because he had got 1/6 from O’Connor to obtain liquor and had not procured the drink that O’Connor gave the accused in charge.

His Honor summed up, and the jury retired at 10 minutes past 11 am to consider their verdict.

About 25 minutes past eleven am, the jury returned into court with a verdict of guilty against both the accused.

The accused were further charged with stealing 1/- from William Hughes, and also with assaulting him. They pleaded not guilty. The case was not proceeded with.

The prisoners were remanded for sentence.

ORANGE QUARTER SESSIONS.
———
Wednesday, November 30.
———
(Before his Honor Judge Docker.)

SENTENCES.
———

Before the Court adjourned yesterday the following sentences were pessed:— [sic]

William Wilson and Joseph Perry, found guilty of assault and robbery, were brought up for sentence. Perry pleaded for leniency as it was the first time he had been in trouble.

Sud-Inspector Ford read a list of twelve previous convictions against Wilson, and one against Perry, who said the charge against him had been laid in error, and the lady charging him with false pretences, had paid his fine for him.

His Honor said he could not differentiate in the sentences he would impose. He then sentenced the prisoners to two years’ with hard labor in Bathurst gaol.
