GOULBURN QUARTER SESSIONS.
———:○:———
Friday.
(Before Acting Judge Hamilton.)
James Doyle, about 35, was charged with indecent exposure, on 29th April, at Black Springs, in a ceratin open place near the dwelling house of divers persons and near the Braidwood and Tarago road and within sight of divers persons.
He was further charged with a similar offence on May 7.
Accused pleaded not guilty, and was defended by Mr Thomas.
The Crown ordered four jurors to stand aside.
Evidence for the prosecution was given by Florence E Batt (15), Priscilla Batt (13), Catherine Batt (mother), and Sergeant Filan of Braidwood.
Accused, a carrier between Tarago and Braidwood, gave evidence denying the offence.
Mr Thomas briefly addressed the jury.
His Honor summed up, saying that it was a question for the jury to say whether they believed the evidence of the two little girls. They were at variance in what they said, and were also at variance with the mother’s evidence. The accused had given a straightforward statement to the constable, which did not compromise him with his evidence that day. If they had a reasonable doubt it should be given to the accused.
The jury retired about 11 o’clock and returned 35 minutes later. The foreman asked two or three questions regarding the evidence, which were answered by his Honor.
His Honor then said he should have told the jury that the accused was apparently a man of good character, and they should take that into consideration.
The foreman said in the event of them not agreeing would his Honor take a verdict of 11 to 1.
His Honor said he would not.
In answer to a juryman it was elicited that the accused was a married man with a family.
The foreman then said the jury had agreed, and without leaving the box they returned a verdict of not guilty, and accused was discharged.

CORRECTION.
In the report of the Quarter Sessions, held in Goulburn on the 8th October, the name of James Doyle was by error, associated with a charge at the Children’s Court for indecent assault. The words should have been “indecent exposure,” and we regret that the mistake occurred.
