QUARTER SESSIONS.

…
Thomas Kelly, charged with that he did on Nov 5 assault George Doodson, also with carnally knowing him, pleaded not guilty.
    Accused was undefended.

George Doodson, 10 years of age, stated: I live at Walgett, and have seen accused; first saw him in my father’s shop on a Saturday evening; he pulled me down the lane and asked me to go with him; I did not want to go; he told me not to make a noise; he said I’s Tommy the Nut; he put me on the ground and did something dirty. Billy Russell came there; and then a policeman; I was on the ground when he came.

By accused: You did not pull me out of the shop; my mother was there at the time.

William Russell: Live at Walgett with my father; know George Doodson and the accused; saw them together at dusk on Modrzynske’s stool; accused caught hold of Doodson and tried to drag him down the lane; the boy would not go but accused took him. I then went home.

Constable George Jeffrey, stationed at Walgett, stated: Remember 5th Nov; was locking a man up, when I heard cries, and and [sic] on investigation saw the accused (witnesses [sic] description of what he saw is hardly fit for publication); I then arrested accused and conveyed him to gaol, and charged him with the offence; accused made no reply; he was under influence of drink.

By Accused: I was about 2ft off when I struck the light.

Dr Higgins, Walgett, deposed: Examined the boy, and only discovered considerable redness about the arms; I also examined accused; found evidence of recent sexual excitement.

The jury found accused guilty of attempt to commit the offence, and he was sentenced to three years’ penal servitude.
