CASE POSTPONED.

John McDonough was arraigned with having, on March 29, 1915, at Quirindi, in the presence of divers persons, indecently exposed himself. He pleaded not guilty.

The Crown Prosecutor asked for a postponement of the case until next court, on the ground that one of the main witnesses for the Crown was too ill to attend the court. None of the other witnesses were present.

Mr Jas R Carlton, who appeared for accused, in answer to His Honor, said McDonough had been in custody since his arrest.
His Honor said he did not think he could postpone the case, because the man was in gaol.

The Crown Prosecutor informed His Honor that he could have the other witnesses present to-morrow.

His Honor accordingly postponed the case until to-morrow, it being arranged that the depositions of the witness, who is indisposed, should be put in as evidence.

MAITLAND CIRCUIT COURT.
TUESDAY, APRIL 27.
(Before His Honor Mr Justice Pring.)

The Maitland Circuit Court was continued yesterday at the Clubhouse, East Maitland, before his Honor Mr Justice Pring, after our report closed. Mr E Beaver was Judge’s Associate, and Mr WW Perry Crown Prosecutor.
…

WEDNESDAY, APRIL 28.

The court was resumed at 10 o’clock this morning.

IMPROPER BEHAVIOUR.

John McDonough was indicted with having, on March 29, 1915, at Quirindi, in the presence of divers persons, indecently exposed himself. Mr Jas R Carlton appeared for accused, who pleaded not guilty.

Three witnesses for the Crown were examined, Constable Scott and two little children [Kathleen Jane Mary Burke and John Redmayne Burke ], seven and ten years respectively; and the evidence from the lower court of a nursegirl, who was too ill to appear, was put in. The constable stated that accused appeared to be recovering from a drinking bout.

Accused [John McDonough] preferred to make a statement, which amounted to a denial of the charge.

After being absent an hour the jury returned into court, and the foreman intimated that they desired to know whether either of the children had noticed that accused had a pipe in his hand as stated by him; or whether accused slipped on the rock where the children were crayfishing.

The children were brought back into the witness box, but neither of them had noticed a pipe in accused’s hand. The little girl said accused slipped coming down the hill, but not on the rock; the boy did not see him slip at all.

The jury returned into court at three o’clock with a verdict of guilty, with a strong recommendation to mercy on account of prisoner’s advancing years.

His Honor said older men like accused should set an example to younger ones. The sentence of the court was that he be imprisoned with hard labour for twelve months in Grafton Gaol.
