April 4th

Sydney Mills was this day admitted into the Hospital for the Criminal Insane at Parramatta under an order from the Colonial Secretary; he evidently labours under a form of congenial mental deficiency is a nice lad and was sentenced on the 31st of January of this year to twelve months imprisonment for larceny. He is very young, has no hair on his face; his which is pale and of a cadaverous hue; he has light brown hair very light blue eyes and a thin narrow forehead he is very small in stature and stoops somewhat; has an awkward shambling gait; is very morose and will not answer questions of any description. He is described in the accompanying medical certificates as follows– “He has a weak silly expression; he bursts into tears without cause; he speaks in a silly disconnected manner, thinks he is going to be hanged or that some other harm is about to happen to him.” From the warden in charge it appears that he is much addicted to masturbation wets his trousers, cries without cause, tears his clothes, denudes himself and behaves generally like an insane person.

April 11th

This lad does not improve in his mental state; sits about the yard all day taking notice of nothing around evidently oblivious to all external impressions; he will not enter into any kind of conversation & it is with great difficulty he can be induced to answer questions even in monosyllables; his pulse & respiration are in good state he passes his evacuations freely but is so dirty in his habits that these often go into his trousers.

April 18th

He continually gets up at night & walks about his single room & frequently stands in one posture with no apparent object, until put to bed again, this occurs frequently during the night; his general health has somewhat improved since admission; but he is still very imbecile in appearance & manner; appetite improved.

April 24th

This lad was transferred to free Division.

UNNATURAL OFFENCE.

Sydney Mills, charged with this crime, was found guilty. On his behalf it was urged that he was not in his right mind, having two years ago been an inmate of the Lunatic Asylum, but it was proved that he had been several times convicted since he left Gladesville. Mr Coffey, on behalf of the Crown, said he would be content if the jury took the view of the case that the prisoner was not in his right mind, and his Honor charged the jury somewhat to the same effect, but the jury brought in a verdict of guilty, quite setting aside the insanity plea, as they said they considered he was quite sane. He was remanded till the following morning for sentence.

SENTENCES.

…
Sydney Mills, who on the previous day was convicted of having committed an unnatural offence, was sentenced to five years’ penal servitude. In passing this sentence, his Honor said there was no doubt that the prisoner was in 1884 a inmate of a lunatic asylum. Since that time he had received several sentences for larceny, and the medical officer of Darlinghurst goal was of the opinion that he was perfectly sane. It was for the authorities to say whether such a man was insane or not. At any rate, he was not fit to be at large among his fellow men.
