QUARTER SESSIONS

YOUTH SENTENCED
————
“UNFORTUNATE KINK”
————
EIGHTEEN MONTHS' GAOL.
————

Two youths, William Carroll and William Henry Martin, were charged with having broken into the bar of the Locomotive Hotel, Junee, on January 9, and with having stolen a bottle of whisky and £2, the property of the licensee, Albert Entwhistle. Carroll pleaded guilty, and was remanded for sentence. Martin pleaded not guilty.

Mr FC Stellway, of Messrs Throsby Young and Stellway, who appeared for Martin, submitted at the end of the Crown case that there was no case against his client. It had been stated in evidence that the two accused had been drinking heavily, and had left the room in which they were living at the Locomotive Hotel, and had gone downstairs. They had gone towards the back of the building, where Carroll had broken a window, and had entered the bar and stolen the whisky and money. There was nothing, however, to connect Martin with the theft. He had been found on his bed upstairs afterwards.

The jury acquitted Martin without leaving the court.

Carroll was brought in for sentence. Although he was only 19 years of age, there was a formidable list of convictions against him, dating from when he was 14 years old. In sentencing him to eighteen month’s imprisonment in Goulburn gaol his Honor said that he hoped that Carroll would be sent to Cloncurry or Emu Plains, which would be better for him than the usual prison. “You seem to have some unfortunate kink in your constitution.” He said “The convictions against you make one think you are not quite right. In all probability it is drink alone that sends you wrong. You are a decent looking chap, and it is a pity that you cannot get along without making such an arrant beast of yourself. This sentence might straighten you up a bit.”
