CAUSES SWAGMAN’S DEATH.

MAN COMMITTED FOR TRIAL.
————
At an inquest yesterday morning on the body of Patrick Sullivan, who died in Sydney Hospital on January 5, from a fractured skull, Alexander Marina [aka Alexander Marino] was committed for trial on a charge of causing his death.
Henry Langley, a laborer, said that he was standing outside the Sussex Hotel on the morning of January 3. Sullivan was there, and was under the influence of liquor. He told witness that “that little black coon,” indicating Marina, wanted to take his swag. Marina then tried to push Sullivan’s swag over his head, and afterwards hit him on the face. Sullivan turned to Marina, who again hit him lightly on the side of the face. This caused Sullivan to fall, and he struck his head on the roadway. The Ambulance took him to the hospital.
Another witness stated that he saw Marina and Sullivan shaping up to each other. The latter seemed helpless with drink.
Alexander Marina said that he met Sullivan at the corner of Liverpool and Sussex street. Sullivan turned to him and said, “What are you blackfellows doing out here?” He replied, “I have as much right here as you,” and Sullivan struck him several times. Witness then struck deceased with his open hand, causing him to fall. He ran into the hotel and got a glass of water for deceased and then walked away. Hearing the Sullivan had been taken to the Sydney Hospital, he decided to go and see him, but was arrested while he was on the way. He was fairly drunk that day, having had six glasses of rum and milk.
The Coroner recorded a verdict of manslaughter against Marina, and committed him for trial at the Quarter Sessions.

A SWAGMAN KILLED.

INDIAN COMMITTED FOR TRIAL.
At the conclusion of an inquest yesterday the City Coroner (Mr Hawkins) committed Alexander Mariana, an Indian, to stand his trial at the Quarter Sessions on January 19 on a charge of manslaughter.
Marina is alleged to have assaulted Patrick Sullivan, 35, a labourer, in Sussex-street, on January 3. Sullivan, a single man, died two days later in Sydney Hospital from a skull fracture.
In evidence Henry Langley, a labourer, said that on the Saturday at 9 am he was talking to deceased, who had had drink and carried a swag, on the footpath in Sussex-street. Near by stood Alick Martina. Witness said to deceased, “What’s the matter, Paddy?” He replied, “This little black coon wants to take my swag.” Just then Marina tried to shove the swag over his had, and he also hit him on the face with an open hand. Retaliating, deceased asked witness to hols the swag. As he turned towards Marina the latter hit him on the jaw with his fist. It was a light blow, but deceased fell, his head striking the road. Witness then picked the dazed man up, and laid him against his swag on the footpath. He had only been out of Little Bay Hospital a few days. Witness did not see deceased strike Marina on the mouth.
Alexander Marina, a station-hand, said that deceased had said to him and a half-caste companion, “You blackfellows, what are you doing out here?” Witness answered, “I’ve as much right here as you.” Deceased then smacked him across the mouth, saying, “Get away!” Marina laid his hand on deceased’s swag. Thereupon deceased dropped the swag, struck him again, and Marina caused the fatal fall by swinging his open hand on to Sullivan’s face.

QUARTER SESSIONS.
———
(Before Judge Murray and juries.)
Mr Herbert Harris prosecuted for the Crown.
MANSLAUGHTER ACQUITTAL.
Alexander Marina was charged with the manslaughter of Patrick Sullivan, at Sydney, on January 3, Mr EJ Spear defended.
The Crown Prosecutor said the evidence against accused was to slight that he suggested that his Honor should discharge the jury from giving a verdict, which would be equal to an acquittal. The suggestion was agreed to by Mr Spear, who said that his client was a most inoffensive man when not interfered with, and that he had not been charged with any offence previously.
Both jury and accused were discharged.

Mr Herbert Harris, Crown Prosecutor.
ACQUITTED OF MANSLAUGHTER.
Alexander Marina, a native of Madras, was acquitted on a charge of having feloniously slain Patrick Sullivan at Sydney, on January 3.
Mr EJ Spear, appeared for Marina.
The Crown Prosecutor said that the evidence against the accused was so slight that he suggested that his Honor should discharge the jury from giving a verdict, which would be tantamount to an acquittal.
Mr Spear consented to the course, and said that Marina was a most inoffensive man when not interfered with, and that he had never been charged with any offence previously.
The jury was accordingly discharged, as was also the accused.
