CONTAMINATED MILK.

ITALIAN FRUITERER FINED £10.
————
At the Central Police Court this afternoon the case was concluded in which Domenico Caldaia, an Italian fruit vendor, of 69 Oxford-street, was proceeded against by the City Council that he allowed Giovanni Re, then suffering from an infectious disease, to serve milk, not having shown to the satisfaction of the municipal Council of Sydney that the danger of communication of infection to the said milk, or of its contamination had ceased.
The case for the prosecution was that on February 8 last Giovanni Re was arrested on a charge, [see below], and afterwards he made a statement. He said he had been sick for three months. Re had been serving in defendant’s fruit shop and dressing the window. Defendant was also a registered milk vendor.

and Country Journal, Sat 26 May 1883, p. 984.

Domenico Caldaia sated that after the police man came to his shop he did not employ Re. He did not know what Re was suffering from. He asked for a week’s spell, and at Christmas time he first knew Re was in the Little Bay Hospital.
In cross-examination, witness said that when Re was in the hospital he never took the trouble to inquire what he was suffering from.
The Magistrate: Why didn’t you ask him?—It was not my business to find out.
Although you are a milk vendor?—No. He didn’t say anything, and I didn’t ask him anything.
In giving his decision, the magistrate (Mr Barnett) said that he was of the opinion there was sufficient evidence to justify conviction. It was an extremely bad case in one sense, because it was horrible for the public to think that they may have been consuming the milk that may have been handled by a person suffering from disease. I do not think defendant understood the seriousness of his position, because, in reply to my question whether he knew his employee was suffering, he said he did not think it was his business.
Defendant is fined £10, in default two months’ hard labor.
